Regulation 4(1) – Provision of Personal Protective Equipment Every employer shall ensure that suitable personal protective equipment is provided to his employees who may be exposed to a risk to their health or safety while at work except where and to the extent that such risk has been adequately controlled by other means which are equally or more effective.

Under Article 41 (2) (a) of the Constitution of Kenya states that every person has the right to the highest attainable standard of health which includes the right to health care services. Article 43(1) (b) also provides that every worker has the right to reasonable working conditions.
